SCA (SA/NT) invites you to join us for our Lunchtime Learning Webinar in a series of online events and workshops, where we will explore key topics to support you in being informed to manage your strata communities.

In the past, Strata and Community Corporations have often amended their articles and by-laws to include the ability to levy legal costs associated with recovery action against the relevant unit.  This is more commonly referred to as an “Arrears Policy”.  Recent decisions in the Magistrates’ Court of South Australia have challenged the existence of these policies within by-laws – determining that they are ineffectual, and that arrears policies can only be enforced when adopted by a Corporation by unanimous resolution.

This presents a difficult conundrum for Corporations and Body Corporate Managers alike: how do you ensure that your groups have appropriate resolutions in place to enable the recovery of legal costs? How wide should the scope of an arrears policy extend? How does a Corporation achieve a unanimous resolution where a non-financial unitholder prevents it from passing unanimously?

Alice Carter, Partner, Lynch Meyer Lawyers

Alice Carter heads the firm’s Strata and Community Title Team. She is experienced acting for body corporate management firms, representing corporations in all forms of dispute resolution, and providing advice regarding responsibilities and obligations. Alice also provides in-house training to body corporate firms and their staff.

Alice also has significant expertise in debt recovery and insolvency and manages a large volume of files across all Australian jurisdictions. She provides advice on all aspects of the recovery process in an effort to achieve efficient results at a low cost.

Alice is the immediate past President of the Women’s Insolvency Network of South Australia, the immediate past President of the South Australian division of the Australian Institute of Credit Management, and a member of the Australian Restructuring Insolvency & Turnaround Association.



Georgia Gray, Senior Associate, Lynch Meyer Lawyers

Georgia Gray is a member of the firm’s credit, commercial litigation, and insolvency team.

Georgia manages a large strata and community title disputes practice, including issuing proceedings to recover outstanding levies and charges, and acting in disputes relating to use of common property, breaches and the operation of articles and by-laws, contractor disputes and deceased estates. Georgia also provides advice to body corporate management firms as to corporations’ and owners’ rights and responsibilities, amendments to strata and community title plans, and updates to and registration of articles and by-laws. Georgia also provides in-house training to body corporate firms and their staff.

Georgia is a Community Ambassador for Catherine House, a committee member with the Women’s Insolvency Network of South Australia and a member of the Australian Restructuring, Insolvency & Turnaround Association. In 2021, Georgia was named as a finalist in the Lawyers Weekly 30 Under 30 Awards for the insolvency category.
