The SCA (Qld) Standard Administration Agreement
The agreement is the profession’s benchmark agreement in which a body corporate appoints its manager.  The agreement establishes a binding legal relationship (contract) between a body corporate and a body corporate manager. It is only to be used by SCA (Qld) members.

 

It is one of Australia’s pre-eminent standard industry / professional agreements due to the level of consumer protection it affords to a significant number of properties.  The agreement is only available to strata management members of SCA (Qld). Members should be aware that any changes to the agreement are the Member’s responsibility to check with a legal expert.

SCA (Qld) Building Management Statement Manager Agreement
The BMS contract is for body corporate managers who have been engaged by a building management group to provide administrative services under a building management statement (BMS). The usual SCA administrative agreement is not appropriate for this kind of engagement because the rights and obligations of the parties are not prescribed by legislation - instead, they are determined by the provisions of the BMS itself. For that reason, we recommend you carefully consider the relevant provisions of each BMS under which you are engaged (which may differ significantly) and amend the BMS contract to suit your particular circumstances.

SCA (Qld) Chapter 3 Part 5 Agreement

The Chapter 3 Part 5 agreement is for bodies corporate who are unable to have a full committee and seek to engage a body corporate manager.  This engagement can only be made if the body corporate has been unable to fill all executive member positions on the committee or the total number of voting members of the committee is fewer than three. Before considering such an engagement, the body corporate must attempt to elect or appoint a full committee.

SCA (Qld) Engagement of a Body Corporate Manager under BUGTA

The Template Agreement for management by a body corporate manager and the body corporate under the Building Unit and Group Titles Act 1980 stipulates the conditions for managing in accordance with the Act. BUGTA is in
effect for a number of mixed use and resort developments throughout the State which are facilitated by specific legislation referred to as the specified Acts.

SCA (Qld) Engagement of a Body Corporate Manager under MUDA

The Template Agreement for management by a body corporate manager and the body corporate under the Mixed Use Development Act is for schemes that consist of 2 or more different classes of uses and where property is shared between some or all owners and occupiers within the development site. This agreements sets out the terms of engagement between the body corporate and body corporate management company.
