This session will cover giving guidance to Owners Corporations with respect to building defect claims pursuant to the Design & Building Practitioners Act 2020. The Design & Building Practitioners Act 2020 has added an additional avenue for Owners Corporation to explore when considering the pursuit of outstanding building defects. The aim of the Act is to ensure that all the key participants are regulated and that the designs for buildings comply with the Building Code of Australia (BCA) and that any building work done complies with those designs. Practical examples of situations where the Design & Building Practitioners Act 2020 may be enforced will be provided. Often in strata living, conflict escalates to a level at which it cannot be resolved by the parties involved and needs therefore to be taken to mediation and/or NCAT This session will focus on the NSW Fair Trading Mediation process as well as what happens at the NSW Civil & Administrative Tribunal (NCAT). The session will see participants learn not only the procedural process of mediation and NCAT but how to shine as a managing agent. Preparation is also a key part of the process and the session will cover what is expected of a Strata Managing Agent and where Schedule B charges may arise. Additional charges should not be a surprise to client schemes and therefore several tips on how best to approach this will also be explored.
